McDougall Gauley LLP lawyers presented at a Contract Law seminar for the Regina Construction Association ("RCA") on October 6, 2022.
The RCA comprises members in the construction industry in Regina. The RCA describes itself as “the voice of the industry in lobbying and advocacy at the municipal level of government.” The Saskatchewan Construction Association and the Canadian Construction Association are its two integrated partners, representing its members provincially and federally. The RCA provides networking and educational opportunities for its members, as well as access to the BuildWorks hub.
Lawyers from McDougall Gauley with experience in construction law prepared a daylong seminar for RCA members on “Construction Contract Law,” with a focus on onerous contract provisions.
Murray Sawatzky, K.C. is a partner with a broad practice in the areas of litigation and arbitration, including commercial, construction, environmental, and debtor creditor law. He has particular focus on complex commercial and construction dispute resolution. Murray presented on the CCA 1 2021 standard form subcontract, CCDC2 2020 milestone payments, dispute resolution, and other onerous contract clauses (e.g.: “pay when paid” clauses and “extras” clauses). He also presented on The Builders’ Lien Act.
Heather D. Franklin maintains a litigation practice, focusing on commercial, construction, and civil disputes. Heather presented on prompt payment legislation and discussed common questions arising from the new regime, including impacts to milestone date and payments.
Adam MacNeil has a broad practice with experience working on large, complex litigation matters. Adam presented a case law update, which included discussion on limitations periods, the duty of good faith and contractual interpretation.
Travis Sylvestre is an associate with varied experience, including litigation, corporate law, and insolvency and restructuring. Travis presented on holdbacks and comingling trusts.
Angela Stolz is a partner with an extensive practice in the areas of environmental law and construction law, with an emphasis on construction, builders' liens and tendering issues. She is the lead of the firm's Environmental Law Practice Group. Angela presented on termination provisions in construction contracts and discussed recent case law of note on the topic.
